DOLE Releases Labor Advisory for the Month of November

In compliance with the issuance of President Rodrigo Duterte’s Proclamation No. 555 on August 15, 2018, the Department of Labor and Employment (DOLE) reminded all employers to abide by the proper implementation and payment of wages to employees during the three holidays in November 2019.

According to Labor Advisory No. 11-2019, November 1 is a Special Non-Working Holiday in observance of “All Saints’ Day” while November 2 is also an additional Special Non-Working Holiday. On the other hand, DOLE declared the celebration of “Bonifacio Day” on November 30 as a Regular Holiday. However, DOLE says employees who work during the long weekend will only receive the additional pay since a “no work, no pay” rule will take effect on both November 1 and 2.

“If the employee did not work, the no work, no pay principle shall apply unless there is a favorable company policy, practice, or collective bargaining agreement [CBA] granting payment on a special day,” Bello said.

Rules for November 2019 Regular and Special Non-Working Holidays

Other than the implementation of a “no work, no pay” principle for All Saints’ Day, an employee opting to render work during the holiday will receive an additional 30% of their basic wage on the first eight hours of work. Should the employee work overtime, they will also receive an extra 30% of their hourly rate.

Employees who work during a special (non-working) day falling on their rest day will receive an additional 50% of their basic wages on the first eight hours of work. Overtime work on the same day will allow employees to receive an additional 30% of their hourly rate.

The guidelines for “Bonifacio Day” on November 30, 2019, will have employees receiving 100% of their wages on that day, albeit subject to specific implementing rules and regulations applicable to them. Employers should pay employees 200% of their salaries if they work for the first eight hours during the said holiday. If the employee chose to render overtime work, they would also receive an additional 30% of their wages after the first eight hours.

Employees whose rest day falls on “Bonifacio Day” will receive an additional 30% of their basic wage of 200%. If they do overtime work on the same day, the employer shall pay them an extra 30% of their hourly rate.
